1. Agreement to Terms
By accessing and using Just Big Wins, you agree to be bound by these Terms of Service. If you do not agree to any part of these terms, you may not use the Service. Just Big Wins reserves the right to modify these terms at any time. Your continued use of the Service following any changes constitutes your acceptance of the new terms.
2. The Service
Just Big Wins is a SaaS platform that helps real estate investors and wholesalers identify and acquire properties by automating the process of finding new listings in user-defined geographic regions and composing and sending below-market cash offers to listing agents via email. The Service includes AI-assisted communications that are drafted and sent on your behalf based on your configured parameters and guardrails. The Service also classifies and prioritizes incoming responses, and escalates qualifying leads to you for further action.
3. Accounts and Eligibility
You must be at least 18 years old and a legal entity or authorized representative of a business entity to use the Service. The Service is intended for use by real estate investors and wholesalers operating within the United States. By creating an account, you represent and warrant that you meet these eligibility requirements and have the legal authority to bind your business to these terms.
4. Client Responsibilities and Acceptable Use
You are responsible for maintaining the accuracy of all information you provide to Just Big Wins, including your buyer identity, financing information, and campaign parameters. You agree not to use the Service for unlawful purposes, including discriminatory outreach, fraud, or violation of fair housing laws. You must comply with all applicable federal, state, and local real estate laws, regulations, and licensing requirements in your jurisdictions, including the Telephone Consumer Protection Act (TCPA), Controlling the Assault of Non-Solicited Pornography and Marketing Act (CAN-SPAM), and any applicable state attorney general regulations regarding real estate solicitation. You are solely responsible for ensuring that your use of the Service complies with these obligations.
5. AI-Generated Communications
You authorize Just Big Wins to generate and send email communications on your behalf based on your configured parameters, guardrails, and instructions. These communications are drafted by AI systems within the bounds and constraints you establish. You retain full responsibility for the substance, accuracy, and legality of all offers and communications made under your configuration, regardless of whether they were drafted by AI or otherwise. You acknowledge that no AI system is infallible, and you bear the risk that generated communications may contain errors or may not perfectly reflect your intended meaning. Any offer sent through the Service is issued in your name and on your behalf.
6. Fees and Billing
Just Big Wins is offered on a subscription basis at pricing published on our website. Billing occurs monthly at the start of each billing cycle. Subscriptions will automatically renew unless cancelled. No refunds will be issued for partial months. Pricing and billing terms are subject to change upon 30 days' written notice. Details of current pricing, billing procedures, and cancellation policies will be provided in your account settings.
7. Intellectual Property
The Service, including all software, design, text, graphics, and functionality, is the exclusive property of Just Big Wins and its licensors. You retain ownership of any content you upload or provide to the Service. By using the Service, you grant Just Big Wins a non-exclusive, royalty-free license to use, reproduce, and improve your feedback, configuration data, and usage information to enhance the Service and develop new features. You may not copy, modify, distribute, or reverse-engineer any part of the Service.
8. Disclaimers
The Service is provided "as is" without warranties of any kind. Just Big Wins makes no guarantee that the Service will result in any deals, leads, or financial returns. Real estate investment involves inherent risks, and market conditions, property values, and deal availability are beyond our control. You are solely responsible for evaluating properties and making investment decisions based on your own due diligence and judgment.
You are responsible for the substance of all offers. While Just Big Wins provides AI assistance in drafting and sending offers, you are responsible for ensuring that every offer made under your configuration is accurate, lawful, and reflects your true intent and financial capacity.
Just Big Wins provides no investment, legal, or tax advice. You should consult with qualified professionals—including real estate attorneys, accountants, and financial advisors—before making any investment or business decisions. The Service is a tool for outreach only and should not be relied upon as professional counsel.
You are responsible for compliance with all applicable laws. Just Big Wins does not guarantee that the Service complies with all local, state, or federal regulations in your jurisdiction. It is your sole responsibility to ensure that your use of the Service and all communications made through it comply with fair housing laws, email regulations, real estate licensing requirements, and all other applicable laws.
9. Limitation of Liability
To the maximum extent permitted by law, Just Big Wins shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, lost data, or business interruption, even if advised of the possibility of such damages. Our total liability for any claim shall not exceed the fees you paid in the 12 months preceding the claim. Some jurisdictions do not allow the limitation of liability, so this limitation may not apply to you.
10. Termination
Either party may terminate your account at any time. Upon termination, your right to use the Service ends immediately. Just Big Wins may terminate your account without notice if you violate these terms or engage in unlawful activity. Sections that by their nature should survive termination—including Intellectual Property, Disclaimers, and Limitation of Liability—shall remain in effect.
11. Changes to These Terms
Just Big Wins reserves the right to update these Terms of Service at any time. Material changes will be communicated via email or through the Service at least 30 days in advance. Your continued use of the Service after such notice constitutes acceptance of the revised terms.
12. Governing Law
